1. Acceptance of These Terms

These Terms of Service ("Terms") form a binding agreement between you and Canopia ("we", "us", "the operator"), the company that operates Jokaya. By creating an account, logging in, or using any part of the service, you confirm that you have read, understood, and agreed to these Terms, our Privacy Policy, our Rewards & Payment Policy, and our Prohibited Conduct policy, all of which are incorporated by reference. If you do not agree, do not use Jokaya.

2. Eligibility

To use Jokaya you must:

  • Be at least 18 years old. We do not knowingly provide the service to minors, and we will close any account we reasonably believe belongs to a person under 18.
  • Provide accurate, current, and complete registration information, and keep it up to date.
  • Have the legal capacity to enter into a contract in your jurisdiction.
  • Not have been previously banned from Jokaya.

One account per person, per household, and per device. You may create and operate exactly one account. Two people living at the same address or sharing the same device may not each maintain an account without our prior written approval, because advertiser networks treat duplicate household or device activity as fraud and reverse the associated earnings. If we detect multiple accounts linked by identity, address, device, or payment destination, we may suspend or close all of them under Section 9.

3. Description of the Service

Jokaya is a rewards ("get-paid-to") platform. We list offers from third-party advertisers and advertising networks — such as trying apps, completing surveys, signing up for services, or reaching milestones in games. When an advertiser network confirms to us that you completed an offer, we credit your Jokaya account with an amount denominated in US dollars. Once your balance meets the applicable withdrawal threshold and the holding period has elapsed, you can redeem it for gift cards from our catalog.

You understand and agree that:

  • Offers are supplied by third parties. We do not control which offers are available, to whom, in which regions, or at what payout, and availability can change or end at any time without notice.
  • Each offer has its own completion requirements, set by the advertiser. Read them before starting. Completing an offer in a way that does not meet the advertiser's requirements will not earn a credit.
  • Tracking is performed by third-party networks. Tracking can fail for technical reasons outside our control (blocked cookies, VPNs, switching devices mid-offer, ad blockers). Our Rewards & Payment Policy explains what to do if a completed offer is not credited.

4. Credits Are Not Money

Amounts shown in your Jokaya balance are promotional credits expressed in US dollars for convenience. Credits have no monetary value of any kind until a redemption is actually completed and a gift card has been issued to you. Credits are not a deposit, not electronic money, not a stored-value instrument, and not a property right. Credits cannot be transferred between accounts, sold, exchanged outside the service, or inherited. Credits earn no interest.

5. Advertiser Reversals — We May Remove Credits, Including After They Appear in Your Balance

Advertiser networks routinely audit conversions and may invalidate ("reverse" or "charge back") a conversion after initially approving it — for example because of suspected fraud, a returned purchase, a cancelled subscription, duplicate completion, or failure to meet the offer's conditions. Because our credits mirror what the networks actually pay us:

  • We reserve the right to cancel any credit that is reversed by the advertiser network, even after the credit has been displayed in your balance, and even if the reversal occurs weeks after the initial approval.
  • If a reversal occurs after you have already withdrawn the corresponding funds, your balance may go negative, and future earnings will first be applied to that negative balance, as described in the Rewards & Payment Policy.
  • A displayed balance is therefore a good-faith estimate of what you will be able to redeem, not a guarantee.

We commit to passing reversals through honestly: we only remove credits that the network actually reversed, and your account history will show every reversal as a distinct, dated entry.

6. Holding Period Before Withdrawal

Newly earned credits are subject to a maturity ("holding") period before they become withdrawable. The current duration is displayed on the site and in your account. The holding period exists because advertisers need time to validate or reverse conversions; it protects honest users from building withdrawals on credits that later disappear. Details are in the Rewards & Payment Policy.

7. Prohibited Conduct

Certain behavior — including multiple accounts, VPN or proxy use to defeat geographic targeting, emulators, automation, and giving false information to advertisers — is strictly prohibited and can lead to warnings, account freezes, forfeiture of the balance, or a permanent ban. The full list of prohibited behavior, the graduated consequences, and the appeal procedure are set out in our Prohibited Conduct policy, which forms part of these Terms.

8. Your Account and Security

You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. Notify us immediately at contact@canopia.cloud if you suspect unauthorized access. We are not liable for losses caused by your failure to secure your credentials, but we will assist in securing a compromised account.

9. Suspension and Termination; Effect on Your Balance

We may suspend or close your account, with or without notice, if we reasonably believe you have breached these Terms or any incorporated policy, if required by law, or if an advertiser network requires it.

  • Suspension (freeze): your balance is preserved but cannot be redeemed while we investigate. We aim to complete investigations within 14 days.
  • Closure for breach: credits obtained through the breach are forfeited. Credits demonstrably earned legitimately before the breach will be honored where the advertiser networks have paid us for them, unless the account was operated fraudulently as a whole.
  • Voluntary closure: you may close your account at any time. You may first redeem any mature balance above the minimum threshold; any balance below the minimum threshold at closure is forfeited.

Every forfeiture decision can be appealed through the procedure described in the Prohibited Conduct policy.

10. No Guarantee of Earnings

Jokaya is not employment, not an investment, and not a source of guaranteed income. Earnings depend entirely on offer availability, your eligibility for specific offers, and advertiser validation. We make no promise of any particular earning level, and past payouts to other users are not a promise of your results.

11. Taxes

Depending on where you live, rewards may be taxable income. You are solely responsible for determining, reporting, and paying any taxes that apply to your rewards.

For users in the United States: if your redeemed rewards reach $600 or more in a calendar year, we may be required to collect tax information from you (typically IRS Form W-9, including your taxpayer identification number) before allowing further redemptions, and to issue you and the IRS an information return (such as Form 1099). If you do not provide requested tax information, we may withhold further redemptions until you do. See our tax guide for a plain-language overview. Nothing on Jokaya is tax advice.

12. Intellectual Property

The Jokaya platform, its content, and its branding belong to Canopia or its licensors. We grant you a personal, non-exclusive, non-transferable, revocable license to use the service for its intended purpose. Advertiser names and trademarks belong to their respective owners.

13. Disclaimers

The service is provided "as is" and "as available". To the fullest extent permitted by applicable law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-interruption. We do not warrant that any offer will be available, track correctly, or be validated by the advertiser.

14. Limitation of Liability

To the fullest extent permitted by applicable law, Canopia will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits or lost expected rewards. Our total aggregate liability for all claims relating to the service is limited to the greater of (a) the amount you actually redeemed through Jokaya in the 12 months preceding the claim, or (b) fifty US dollars ($50).

Consumer carve-out: some jurisdictions, including certain US states and France, do not allow the exclusion of certain warranties or the limitation of certain damages. Nothing in these Terms excludes or limits liability that cannot be excluded or limited under the mandatory law that applies to you, including liability for willful misconduct, gross negligence, or personal injury caused by our negligence.

15. Changes to These Terms

We may modify these Terms. Each version carries a version number and effective date shown at the top of this page. For material changes, we will notify you (by email or an in-product notice) at least 14 days before the new version takes effect, and we will ask you to re-accept the updated Terms at your next login before you continue using the service. If you do not accept, you may close your account and redeem any mature balance above the minimum threshold. Continued use after the effective date constitutes acceptance. Prior versions are archived and available on request at contact@canopia.cloud.

16. Governing Law and Dispute Resolution

These Terms are governed by French law, and disputes are subject to the jurisdiction of the French courts, because Canopia is a French company.

However, if you are a consumer, this choice does not deprive you of the protection of mandatory consumer-protection rules of the place where you live. If you reside in the United States, you keep any non-waivable rights and remedies granted by the laws of your state, and you may bring claims in a forum required by those laws where the law so provides. Nothing in this section waives rights that cannot be waived by contract.

Before starting any formal proceeding, please contact us at contact@canopia.cloud; most disputes are resolved within days through support. We will confirm receipt of a formal complaint within 7 days and respond on the merits within 30 days.

17. Miscellaneous

  • If any provision of these Terms is found unenforceable, the remainder stays in effect, and the unenforceable provision is replaced by a valid one that best matches its intent.
  • Our failure to enforce a provision is not a waiver of it.
  • You may not assign your rights under these Terms. We may assign ours in connection with a merger, acquisition, or sale of assets, with notice to you.
  • These Terms, together with the policies they incorporate, are the entire agreement between you and us regarding the service.
